Seller of goods offered in the online store www.smilga-spalvina.lv SIA "SMILGA SPALVIŅA", reg. no. 42103113498, address: 11A Plānupes Street, Inčukalns, Inčukalna Parish, Siguldas District, LV-2141, Latvia, phone +371 28772467, e-mail: [email protected] (further in text - the Seller), on the one hand, and the person performing the order (further in text - the Buyer), on the other hand, enters into the following Agreement:


The Seller undertakes to sell and deliver the goods to the Buyer in accordance with the Buyer's order.

Ordering, delivery and payment procedures

  1. In the ORDER section of the website, the buyer fills in the order form, indicating the necessary information (name, surname, e-mail, telephone, delivery address, company name, registration number and legal address, bee queen type an number of bee queens). The buyer confirms that he agrees with the online store's terms of use and privacy policy and submits it.
  2. The seller prepares and sends an invoice for the order to the e-mail address provided by the buyer. The invoice is prepared electronically and is valid without a signature.
  3. By paying the invoice, the buyer confirms his order information.
  4. The seller prepares order for delivery and sends after payment confirmation.
  5. The buyer is obliged to accept the order on the day of delivery from the courier.
  6. If the order cannot be fulfilled and the Buyer has paid for the order, the Seller shall contact the Buyer and agree on a refund.
  7. We reserve the right to unilaterally cancel the order and return the payment to the buyer.

Delivery and Payment methods

  1. For shipping we use courier services to provide delivery in 1-10 working days. Delivery time depends on destination country.
  2. Shipping costs vary by country: 
    • 15 EUR in Baltic States,
    • 25 EUR in rest of Europe (in Finland postal codes from 0xxxx to 6xxxx)*,
    • *Additional shipping costs apply in Finland and Sweden depending on the postal code of the delivery address. For example, in Finland, delivery to an address with postal code 9xxxx is 70 EUR.
    • Delivery outside Europe from 160 EUR. Please contact us individually about options and delivery costs.
  3. Only payment method is wire transfer (bank transfer) after receiving invoice.
  4. Order will be prepared for delivery and sent after payment confirmation and queen's availability. The delivery date will be agreed in advance with the customer.

Warranty

  1. The buyer is obliged to accept the order on the day of delivery from the courier. SIA "SMILGA SPALVIŅA" has a “No Returns” policy on the order and shipping of Queen Bees. However, if at the time of receiving the order, the queens are not alive, please contact us immediately writing to Whatsapp +371 28772467 or e-mail [email protected]. To confirm that the queens are not alive, please take a photo upon receiving of the shipment. In such cases, we provide replacement of the order free of charge, in agreement with the Buyer.
  2. SIA "SMILGA SPALVIŅA" can not be held responsible for delayed shipments in the cases: fortuitous event: roadblocks, land subsidence near the road, falling bridges, accidents, mechanical breakdowns that may occur in the mode of transport, etc .; natural causes: storms, fires, floods, snow or frost, etc.; human causes: war, strikes, revolutions, etc.

This privacy policy informs about privacy practices and principles of personal data processing in connection with SIA "SMILGA SPALVIŅA", reg. no. 42103113498, address: Plānupes Street 11A, Inčukalns, Inčukalna Parish, Siguldas region, LV2141, Latvia, website www.smilga-spalvina.lv and services.   1. When placing an order, the Buyer has read the privacy policy and regulations and agrees that the data provided by the Seller is used by the Seller to fulfill the order (acceptance of the order, processing, dispatch of goods, provision of the service). The Buyer agrees that notifications regarding the processing of orders will be sent to the e-mail address and / or telephone number provided by the Buyer.
  2. By providing information about yourself (name, surname, e-mail address, telephone number, delivery address, and other information you wish to provide) through the online store services, the Buyer grants the Seller the right to use the information and data provided directly and indirectly for statistical purposes, to improve the quality of the services provided.
  3. The Buyer's data will be used only by the Seller and its partners who provide the administration of the online store, delivery of goods and other services related to the execution of the order. The Seller confirms that the data provided by the Buyer will not be disclosed and transferred to third parties, except in cases specified by the laws and regulations of the Republic of Latvia.
  4. The Seller uses various technical and organizational security measures to protect your personal data. Your personal data is only available to a limited number of authorized people.
  5. The Seller shall store your personal data for as long as it is necessary in accordance with the purpose for which it was obtained and as permitted or required by law.

Jurisdiction

The applicable legislation is the legislation of the Republic of Latvia. All disputes and disagreements that may arise for the Seller and the Buyer during the performance of this Distance Agreement or in connection therewith and which the Seller and the Buyer will not be able to resolve through negotiations, the Seller and the Buyer shall submit to court in accordance with the external regulatory enactments of the Republic of Latvia.
